Ko\u0142\u0142\u0105taja 32 50-005 Wroc\u0142aw NIP: 9291566483, REGON: 081110501.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 2 Definitions<\/h4>\n\n<ul class=\"wp-block-list\">\n<li>Order lead time - the time taken for an order placed by the Customer to be completed and submitted for dispatch. The order lead time does not include the days during which the Online Shop waits for the Customer to make payment (if a form of payment other than cash on delivery is selected).<\/li>\n\n<li>Working days - all days of the week from Monday to Friday, excluding public holidays and Saturdays.<\/li>\n\n<li>Password - a unique series of characters (digits or letters) chosen by the Customer, which the Customer assigns in the Service system for the purpose of confirming his\/her identity; the Password is confidential and the Customer should keep it secret.<\/li>\n\n<li>Customer (i) a natural person with at least limited legal capacity and at least 18 years of age, and (ii) a legal person or an organisational unit without legal personality with legal capacity.<\/li>\n\n<li>Customer Account - means an account on the Website created with the Customer's data (name, surname and e-mail address).<\/li>\n\n<li>Basket - an element of the On-line shop, where the Customer specifies the details of the order, such as delivery address, invoice details, delivery method, payment method, and other data if their provision is necessary in connection with the fulfilment of the order.<\/li>\n\n<li>Costs of delivering the Goods - means the costs incurred for the purpose of delivering the Goods to the Customer in accordance with the order made by the Customer.<\/li>\n\n<li>Login - the Customer's identifier on the Website - a series of characters (numbers or letters) assigned to the Customer.<\/li>\n\n<li>Warehouse - the place where the order placed by the Customer is completed.<\/li>\n\n<li>Newsletter - commercial information concerning the activities of the Seller, including in particular promotions, news, loyalty programmes.<\/li>\n\n<li>Authorised Person - The Customer or another adult person nominated by the Customer who is entitled to receive an order placed by the Customer and to exercise all the Customer's rights, with the exception of the right to withdraw from the contract and the rights arising from liability for the conformity of consumer goods with the contract or the rights arising from the guarantee, if such a guarantee has been issued for the product in question.<\/li>\n\n<li>Service - the DiukOptyk.co.uk website, operating at: https:\/\/dukeeyewear.co.uk<\/li>\n\n<li>Salon - a stationary optical salon run by the Seller.<\/li>\n\n<li>Online Shop - the platform operating within the Website, enabling the Customer to place orders for Goods.<\/li>\n\n<li>Seller - cash and cash on delivery and stationary sales: Diuk Optyk Marcin Lechna Ul. Ko\u0142\u0142\u0105taja 32 50-005 Wroc\u0142aw NIP: 9291566483, REGON: 081110501, cash and cash on delivery payments, personal collection: Diuk Optyk Marcin Lechna Ul. Ko\u0142\u0142\u0105taja 32 50-005 Wroc\u0142aw NIP: 9291566483, REGON: 081110501<\/li>\n\n<li>Contract of sale - a contract of sale of Goods within the meaning of Article 535 of the Civil Code, concluded between the Seller and the Customer.<\/li>\n\n<li>Goods - an article for which an order can be placed in the Online Shop.<\/li>\n\n<li>Foreign order - an order the delivery of which is to take place within the European Union, outside the territory of the Republic of Poland.<\/li>\n<\/ul>\n\n<h4 class=\"wp-block-heading\">\u00a7 3 Registration on the Website<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>The status of a registered user of the Service is obtained by performing the following actions:\n<ul class=\"wp-block-list\">\n<li>a) registering on the Website;<\/li>\n\n<li>b) Activate the account by clicking on the link sent to the Customer's e-mail address;<\/li>\n\n<li>c) logging on to the Website using the Login and Password.<\/li>\n<\/ul>\n<\/li>\n\n<li>Along with registration on the Website, the Customer obtains access to a Customer Account, enabling him\/her to place orders for Goods in the Online Shop, to reserve Goods in a designated showroom, to access his\/her purchase history, as well as to access, modify and delete Customer data.<\/li>\n\n<li>Customers are obliged to store the data necessary for registration on the Website in such a way that it cannot be accessed by unauthorised third parties.<\/li>\n\n<li>Use of the Service is available to Customers with the following equipment:\n<ul class=\"wp-block-list\">\n<li>(a) a PC or mobile phone, tablet or other Internet-enabled device;<\/li>\n\n<li>(b) a broadband Internet connection;<\/li>\n\n<li>c) the current version of the web browser Firefox, Chrome, Safari or Edge;<\/li>\n\n<li>d) JavaScript, frames and CSS styles enabled;<\/li>\n\n<li>(e) pop-up windows enabled for the diukoptyk.pl domain;<\/li>\n\n<li>(f) an active e-mail account.<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 4 Service principles<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>The Seller shall provide services to the Customer to the extent and under the conditions set out in these Terms and Conditions.<\/li>\n\n<li>The Seller undertakes to comply with these Terms and Conditions.<\/li>\n\n<li>It is forbidden for the Customers to provide unlawful content and to use it in a way that is not onerous for the other Customers and the Seller, which is communicated in these Terms and Conditions.<\/li>\n\n<li>The use of the Online Shop shall mean any action by the Customer leading to him\/her becoming acquainted with the content of the Online Shop.<\/li>\n\n<li>In connection with the provision of electronic services, the Seller uses software and technology that ensures the security, confidentiality and integrity of the data\/information transmitted.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 5 Terms and conditions for placing orders in the Online Shop<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>The customer has the option to conclude a sales contract electronically by filling in a form available in the Online Shop as part of the electronic services provided.<\/li>\n\n<li>The contract is concluded upon:\n<ul class=\"wp-block-list\">\n<li>a) acceptance of the content of the Order sent to the Customer;<\/li>\n\n<li>(b) to agree to its implementation;<\/li>\n\n<li>c) accept the content of these Terms and Conditions;<\/li>\n\n<li>(d) acknowledgement of knowledge of the right of withdrawal.<\/li>\n<\/ul>\n<\/li>\n\n<li>The contract of sale shall be concluded in accordance with these Terms and Conditions.<\/li>\n\n<li>The Seller may terminate the agreement for the provision of electronic services with immediate effect if the Customer provides unlawful content or violates the content of these Terms and Conditions.<\/li>\n\n<li>The persons authorised to place orders for Goods in the Online Shop are the Customers:\n<ul class=\"wp-block-list\">\n<li>a) having the status of a registered user of the Website;<\/li>\n\n<li>b) not having the status of a registered user of the Website - making purchases without registering and logging in.<\/li>\n<\/ul>\n<\/li>\n\n<li>The information provided on the website of the Online Store does not constitute an offer within the meaning of the Civil Code, but constitutes an invitation to submit offers by Customers. Conclusion of a Sales Agreement requires prior submission of an order by the Customer and its subsequent verification by the Seller, among others, as regards the availability of the Goods.<\/li>\n\n<li>The Customer with the status of a registered user of the Website places an order after logging in to the Website, by adding the Goods presented in the Online Shop to the Basket, selecting courier delivery or the option of collection, then confirming the order for the Goods by selecting the button - \u201eOrder and pay\u201d. Initial verification of the order will be made by sending to the Customer via e-mail information about the order placed by the Customer.<\/li>\n\n<li>The Customer who does not have the status of a registered user of the Website places an order by adding the Goods presented in the Online Shop to the Basket, selecting courier delivery or the option of collecting them from the Showroom, then confirming the order for the Goods by selecting the button - \u201eI order and pay\u201d and providing the data necessary to complete the order in accordance with the procedure on the Online Shop website. Initial verification of the order will be carried out by sending to the Customer, via e-mail, information about the order placed by the Customer.<\/li>\n\n<li>Orders can be placed in the Online Shop 24 hours a day, all days of the year, and are processed on working days.<\/li>\n\n<li>The Seller reserves the right to carry out additional verification of the Customer's data in justified cases, e.g. by telephone contact.<\/li>\n\n<li>In the order, the customer may additionally indicate the data required for a VAT invoice if he or she requests a VAT invoice.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 6 Conclusion of the Sales Contract<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>As soon as the Seller confirms acceptance of the Customer's order for processing, the contract of sale of the Goods is concluded. Confirmation takes place by sending to the Customer via e-mail information in which the Seller confirms acceptance of the Customer's order for processing.<\/li>\n\n<li>The prices quoted in the Online Shop are binding and cannot be negotiated. The prices of Goods in the Online Shop do not apply to sales made in the Showroom. The price of the Goods given in the Online Shop does not include the cost of delivery of the Goods in the territory of the Republic of Poland. In the case of domestic and foreign orders, the cost of delivering the Goods shall be added to the price of the Goods. The amount of the Cost of Delivery of the Goods is indicated in the Basket during the order placement process.<\/li>\n\n<li>The customer has the right to choose the following forms of payment:\n<ul class=\"wp-block-list\">\n<li>a) payment by bank transfer via the service <strong>Przelewy24<\/strong> - PayPro S.A. ul. Kanclerska 15, 60-327 Pozna\u0144;<\/li>\n\n<li>b) payment by traditional bank transfer to the bank account given after finalising the order;<\/li>\n\n<li>(c) payment <strong>BLIK<\/strong> carried out by Przelewy24;RevolutRevolut<\/li>\n\n<li>d) payment in cash (cash on delivery) or at the courier, subject to \u00a7 7.3 below;<\/li>\n\n<li>(e) payment by card or bank transfer using <strong>PayPal<\/strong> - PayPal Sp. z o.o. ul. Emilii Plater 53, 00-113 Warsaw.<\/li>\n\n<li>(f) payment by card or bank transfer using <strong>Stripe<\/strong> - Stripe Payments Sp. z o.o. ul. Ludwika Wary\u0144skiego 3A, 00-645 Warsaw;<\/li>\n\n<li>(g) payment through the app <strong>InPost Pay<\/strong> - AION Bank S.A. ul. Dobra 40, 00-344 Warsaw.<\/li>\n\n<li>(h) payment by card or bank transfer using <strong>Revolut<\/strong> - for the currency PLN: AION S.A Sp\u00f3\u0142ka akcyjna Branch in Poland, Dobra 40, Warsaw and for other currencies including EUR: Revolut Bank UAB, Konstitucijos ave. 21B, Vilnius, LT-08130, Lithuania;<\/li>\n<\/ul>\n<\/li>\n\n<li>Acceptance of an order for processing if a payment method other than cash on delivery or cash or card on delivery is selected is subject to prior payment for the ordered Goods.<\/li>\n\n<li>The Seller delivers the Goods to the Customer together with a document confirming the conclusion of the contract of sale of the Goods, i.e. a fiscal receipt or a VAT invoice, if the Customer has requested its issuance when placing the order and has provided the necessary data for issuing the invoice.<\/li>\n\n<li>The Customer's obligations under the contract for the sale of Goods shall continue until the Goods and the Delivery Costs have been paid in full.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 7 Delivery<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>Subject to the provisions of paragraph 8 below, the lead time for Goods ordered from the Online Shop is no more than 14 working days. The period for delivery of the Goods runs from the date of sending to the Customer a confirmation of acceptance of the order for fulfilment. When sending the confirmation of acceptance of the order for fulfilment to the Customer, the Online Shop may inform the Customer about the expected delivery time.<\/li>\n\n<li>The customer can choose as the form of delivery:\n<ul class=\"wp-block-list\">\n<li>a) collection by the Customer at the address indicated in the order placed by the Customer;<\/li>\n\n<li>b) collection by a third party indicated by the Customer, at the address indicated by the Customer;<\/li>\n<\/ul>\n<\/li>\n\n<li>If the Customer chooses delivery to a third party at the address specified by the Customer as the method of delivery, then payment for the order must be made before the Goods are dispatched to the Customer. The Customer accepts that with such a method of delivery specified, the Goods will only be delivered to the person designated by the Customer.<\/li>\n\n<li>Any orders that have been paid for by the customer before the delivery date will only be issued to the customer or the person designated by the customer in the order placed.<\/li>\n\n<li>Delivery of the parcel, containing the ordered Goods, to the address indicated by the Customer will be carried out on a working day by a courier company. Details of the courier company are indicated in the Shop.<\/li>\n\n<li>Delivery is attempted twice. After the second unsuccessful delivery attempt, the Goods will be returned to the Seller. The Customer will be notified of the return of the Goods to the Seller by sending correspondence to the Customer at the e-mail address provided in the order. With regard to Goods where the form of payment was payment on delivery, after the third unsuccessful delivery attempt, the order placed by the Customer is automatically cancelled.<\/li>\n\n<li>In the event that collection from the Showroom at ul. Ko\u0142\u0142\u0105taja 32, 50-005 in Wroc\u0142aw is indicated as the method of delivery, the Customer shall be informed by e-mail or telephone of the delivery of the ordered Goods. The Customer is obliged to collect the Goods from the Showroom within 7 days of receiving the information. If the Goods are not collected by the Customer within the indicated period, the order shall be cancelled. The Customer will be notified of the cancellation of the order by sending correspondence to the Customer at the e-mail address provided in the order. With regard to Goods where payment has been made in advance, the amount paid will be refunded within 21 days, in the form in which it was paid.<\/li>\n\n<li>In the case of International Orders, the lead time may be extended, of which the Customer will be informed at the time of placing the order.<\/li>\n\n<li>The costs of delivering the Goods, which are to be borne by the Customer in addition to the price of the Goods, are stated on the website of the Online Shop when placing the order.<\/li>\n\n<li>The Seller undertakes to supply Goods without defects.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 8 Withdrawal from the Sales Contract<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>The Customer - Consumer may withdraw from the sales contract by completing and sending a statement to the e-mail address of the Seller or by registered letter to the address of the company's registered office within 14 days from the receipt of the goods referred to in paragraph 4.<\/li>\n\n<li>The Customer-Consumer may withdraw from the Contract without giving any reason.<\/li>\n\n<li>In the event of withdrawal from a Contract concluded at a distance, the Contract shall be deemed not to have been concluded.<\/li>\n\n<li>Subject to paragraph 10 below, the Customer, who is a consumer, may return the Goods purchased from the Online Shop without stating a reason and incurring costs by submitting to the Seller a declaration of withdrawal from the contract of sale of the Goods in accordance with Article 27 of the Act of 30 May 2014 on consumer rights. The Customer may exercise this right within 14 days of receiving the Goods. It is sufficient to send the declaration before the expiry of the deadline. In the case of withdrawal from the contract of sale of the Goods according to the procedure indicated in this paragraph, the Customer shall be obliged to return the Goods to the Online Shop, within 7 days from the date of submission of the declaration of withdrawal from the contract of sale of the Goods.<\/li>\n\n<li>In the event of withdrawal from the contract of sale of the Goods, the contract of sale of the Goods shall be deemed not to have been concluded.<\/li>\n\n<li>In the event of withdrawal from the contract according to the procedure indicated in paragraph 4 or paragraph 5, the Customer is obliged to return the Goods to the Online Shop at the following address: Diuk Optyk Marcin Lechna ul. Ko\u0142\u0142\u0105taja 32 50-005 Wroc\u0142aw<\/li>\n\n<li>In the event that the return of the Goods is made within the territory of Poland, it shall take place at the expense of the Customer. In the event that Goods are returned from outside Poland, the cost of returning the Goods shall be borne by the Customer.<\/li>\n\n<li>The right of withdrawal does not apply to the consumer in the cases specified in detail in Article 38(1) of the Consumer Rights Act of 30 May 2014, inter alia with regard to contracts:\n<ul class=\"wp-block-list\">\n<li>(a) for the provision of services where the trader has supplied the service in full with the express consent of the consumer who has been informed before the performance begins that he will lose his right of withdrawal once the trader has provided the service;<\/li>\n<\/ul>\n<\/li>\n\n<li>If the Customer exercises the right of withdrawal from the contract of sale of the Goods after requesting the Seller to commence the performance of the service before the expiry of the withdrawal period, the Customer will be obliged to pay for the services performed until the withdrawal from the contract.<\/li>\n\n<li>The Seller shall return to the Customer the amount due for the Goods returned by the Customer within 14 days, counting from the day of delivery of the Seller's statement of withdrawal from the contract of sale of the Goods. The Seller may withhold reimbursement of payments received from the Customer until it has received the returned Goods back or the Customer has provided proof of return of the returned Goods.<\/li>\n\n<li>Withdrawal from the contract of sale of the Goods can be made by completing the form for withdrawal from the contract of sale of the Goods available on the website.<\/li>\n\n<li>The seller warns that under the law, the customer is liable for any diminution in the value of the goods as a result of handling other than that which is necessary to become familiar with the nature, properties and functioning of the goods. In the case of glasses or accessories, infringement of the original markings will result in the goods being treated as tampered with and non-returnable.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 8 Complaints<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>A customer who is a consumer and acquires Goods for non-business purposes shall have rights under the provisions of the Consumer Rights Act of 30 May 2014.<\/li>\n\n<li>A claim for Goods should be:\n<ul class=\"wp-block-list\">\n<li>(a) sent to:<br \/>Complaints:<br \/>Diuk Optyk Marcin Lechna<br \/>Kollataja Street 32 50-005 Wroc\u0142aw<\/li>\n\n<li>(b) sent to the e-mail address: diuk@diukoptyk.pl<\/li>\n<\/ul>\n<\/li>\n\n<li>The Goods complaint will be dealt with up to 14 days from the date of the complaint. The Customer shall be notified by e-mail or telephone of the manner in which the Goods complaint will be dealt with.<\/li>\n\n<li>The Seller informs the Customer of the possibility to use out-of-court ways of dealing with Goods complaints, among others by means of submitting by the Customer, after completion of the complaint procedure, an application to initiate mediation or an application to deal with the case before an amicable court (the application can be downloaded at the website: http:\/\/www.uokik.gov.pl\/download.php?plik=6223). The list of Permanent Consumer Arbitration Courts operating at Provincial Inspectorates of Trade Inspection is available at: http:\/\/www.uokik.gov.pl\/wazne_adresy.php#faq596. Out-of-court settlement of claims after the complaint procedure is free of charge. In the case of a Customer who is a consumer and wishes to use the out-of-court method of claim redress, there is additionally the possibility to file a complaint via the EU ODR online platform, available at http:\/\/ec.europa.eu\/consumers\/odr\/.<\/li>\n\n<li>A complaint shall be submitted in accordance with the procedure and principles described in detail in the Complaint Submission procedure on the Shop's website.<\/li>\n\n<li>The consumer has the right to lodge a complaint based on the warranty on the basis of Art. 556 et seq. Civil Code.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 9 Newsletter<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>The Customer has the possibility to order sending information in the form of the Newsletter from the Online Shop to the e-mail address provided by the Customer. By placing an order for sending the Newsletter, the Customer simultaneously assures that he\/she is authorised to dispose of the e-mail address to which the information is to be sent.<\/li>\n\n<li>The Customer is entitled to unsubscribe from the Online Shop Newsletter at any time.<\/li>\n\n<li>By subscribing to the newsletter, the customer agrees to receive commercial information by electronic means, in accordance with the Act of 18 July 2002 on the provision of electronic services and Article 6(1)(a) of the RODO.<\/li>\n<\/ol>\n\n<h4 class=\"wp-block-heading\">\u00a7 10 Data protection and other<\/h4>\n\n<ol class=\"wp-block-list\">\n<li>The Seller undertakes to protect personal data in accordance with data protection legislation (including the Personal Data Protection Act of 10 May 2018 and RODO - EU Regulation 2016\/679). In accordance with this Act, the Buyer agrees to the storage and processing of this data for marketing and record-keeping purposes, for the Seller's use only. The Buyer has the right to inspect his\/her data, to correct it and to request the discontinuation of its use. All transactions using card payments, are processed by an external partner. We do not collect or maintain any information related to our buyers' payment cards. All information is securely transmitted via SSL protocol to an authorised billing server of the companies: PayPro S.A - Przelewy24.pl, PayPal - PayPal Sp. z o.o., Stripe - Stripe Payments Sp. z o.o., Revolut - AION S.A, Revolut Bank UAB. In accordance with the new RODO regulation, the principle of customer data security is taken seriously, so any breaches of data security will be reported to the relevant services as well as to the data owner himself.\n<ul class=\"wp-block-list\">\n<li>a) The administrator of your personal data is Marcin Lechna, e-mail: diuk@diukoptyk.pl<\/li>\n\n<li>(b) For matters relating to your data, please contact the Data Protection Officer, e-mail: diuk@diukoptyk.pl<\/li>\n\n<li>c) The data will be processed for the sole purpose of informing you about promotions and processing orders on the basis of Article 6(1)(a) and Article 6(1)(b) of the DPA.<\/li>\n\n<li>(d) Data may be shared with consent for the proper performance of the services set out in the regulations.<\/li>\n\n<li>e) Data may be transferred outside the European Economic Area or to an international organisation. The controller informs you that safeguards have been put in place for this purpose, for a copy of your data please contact the Data Protection Officer.<\/li>\n\n<li>f) Order data will be stored for a period of 2 years after entry for the sole purpose of confirming the guarantee of the purchased goods.<\/li>\n\n<li>g) You have the right to access, rectify, erase or restrict the processing of your personal data.<\/li>\n\n<li>(h) You have the right to object to further processing and, where you have given your consent to processing, to withdraw it.
